3. Lead Data License

Upon purchase, Pure Profit Leads grants you a limited, non-exclusive, non-transferable, revocable license to use the purchased lead data solely for the purpose of insurance solicitation in accordance with all applicable federal, state, and local laws. This license does not constitute a sale or transfer of ownership of the lead data. We retain all rights, title, and interest in the underlying data and databases. You acknowledge that lead data may be sold to more than one buyer unless explicitly designated as exclusive.

4. Pricing and Payment

All prices for lead packages and services are displayed on our website and are subject to change without prior notice. Payment is due in full at the time of purchase. We accept the payment methods listed on our website at the time of checkout.

All lead purchases are final and non-refundable. By completing a purchase, you acknowledge and agree that you will not seek a refund, chargeback, or payment dispute for any lead order. Chargebacks or payment disputes initiated without valid cause may result in suspension of your account and pursuit of all available legal remedies.

5. Replacement Guarantee

Pure Profit Leads offers a replacement guarantee for leads that meet the following specific criteria:

Disconnected Number: The phone number on the lead is disconnected or no longer in service.
Wrong State: The lead's state of residence does not match the state specified in your order.
Fictitious Name: The lead contains a clearly fictitious or fabricated name (e.g., "Mickey Mouse").
Over Age 85: The individual on the lead is over 85 years of age.
Non-English Speaking: The individual does not speak English, and English-speaking leads were specified in your order.
Duplicate Lead: The same lead appears more than once within the same order.

Reporting Requirements: All replacement requests must be submitted in writing to dangelo@pureprofitleads.com within thirty (30) days of the original delivery date. Requests must include the lead details and the specific reason for replacement from the criteria listed above.

Replacements are your sole and exclusive remedy for any defective leads. No refunds, credits, or other forms of compensation will be issued in lieu of replacements. Replacement leads are provided on a one-for-one basis and are not subject to further replacement guarantees.

6. Buyer Responsibilities

As a buyer of leads from Pure Profit Leads, you represent, warrant, and agree to the following:

TCPA Compliance: You will comply with the Telephone Consumer Protection Act (TCPA) and all related regulations when contacting leads, including but not limited to obtaining any required consent before making calls or sending text messages.
DNC Scrubbing: You are solely responsible for scrubbing all purchased leads against the National Do Not Call (DNC) Registry and any applicable state DNC lists before making any contact.
Licensing: You hold all necessary and valid insurance licenses required by the states in which you intend to solicit business using the purchased leads.
Legal Compliance: You will comply with all applicable federal, state, and local laws, rules, and regulations governing telemarketing, insurance solicitation, data privacy, and consumer protection.
Data Security: You will implement reasonable security measures to protect lead data from unauthorized access, disclosure, or misuse.

7. Prohibited Uses

You agree that you will NOT:

Resell, redistribute, sublicense, or otherwise transfer purchased lead data to any third party without prior written consent from Pure Profit Leads.
Use lead data for any purpose other than legitimate insurance solicitation.
Use lead data to harass, threaten, defraud, or engage in any illegal activity directed at the individuals on the leads.
Share lead data with unauthorized parties, including but not limited to unlicensed agents, competitors, or data brokers.
Attempt to reverse-engineer, scrape, or extract data from our website or systems beyond what is provided through normal purchase transactions.
Use our services in any manner that could damage, disable, overburden, or impair our website or interfere with any other party's use of our services.

Violation of any prohibited use may result in immediate termination of your account, forfeiture of any remaining leads, and pursuit of legal action.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Pure Profit Leads, its owner, employees, agents, and affiliates shall not be liable for:

Any sales outcomes, conversion rates, or revenue generated (or not generated) from the use of purchased leads.
The quality, accuracy, or completeness of lead data beyond what is covered under our Replacement Guarantee (Section 5).
Any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.
Any damages arising from your failure to comply with applicable laws or these Terms.

In no event shall our total liability to you for all claims arising out of or related to these Terms or your use of our services exceed the total amount you paid to Pure Profit Leads for the specific order giving rise to the claim.

9. Disclaimer of Warranties

EXCEPT AS EXPRESSLY PROVIDED IN OUR REPLACEMENT GUARANTEE (SECTION 5), ALL LEADS AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. PURE PROFIT LEADS MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
Any guarantee of specific close rates, return on investment (ROI), or sales performance.
The accuracy, reliability, or timeliness of lead information beyond the replacement criteria specified in Section 5.
Uninterrupted or error-free access to our website or services.

You acknowledge that the success of insurance solicitation depends on many factors beyond our control, including but not limited to your sales skills, market conditions, and the individual circumstances of each lead.

10. Indemnification

You agree to indemnify, defend, and hold harmless Pure Profit Leads, its owner D'Angelo Antonio, and any employees, agents, contractors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

Your use or misuse of purchased lead data.
Your violation of these Terms.
Your violation of any applicable law, regulation, or third-party right, including TCPA, DNC regulations, and state insurance laws.
Any claim brought by a consumer or third party resulting from your contact or solicitation activities using our leads.
Any unauthorized or unlawful use of lead data by you or anyone who gains access to lead data through you.

11. Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be resolved through binding arbitration administered in Miami-Dade County, Florida in accordance with the rules of the American Arbitration Association (AAA). The arbitration shall be conducted by a single arbitrator, and the arbitrator's decision shall be final and binding on both parties.

You agree that any arbitration shall be conducted on an individual basis and not as a class action, collective action, or representative proceeding. You waive any right to participate in a class action lawsuit or class-wide arbitration against Pure Profit Leads.

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
